Settlement Fund claims pause
We are reaching out to inform you that the YDC Settlement Fund Claims Administrator has implemented a temporary pause on the processing of claims and payments. Specifically, the Administrator has extended many of the dates and deadlines for currently pending Settlement Fund claims by 30 days. Currently, this extension is in effect through Monday, June 24th, meaning that it will impact all deadlines that fall between now and June 24th.
Specifically, the pause will impact the following stages of the Settlement Fund Process:
- The Administrator providing notice that a claim has been received
- The Administrator determining if a claim packet is complete for the Attorney General Designee’s review
- The Attorney General Designee providing a position letter regarding a settlement claim (Offer Letter)
- Pending negotiations with the Attorney General Designee
- Submitting the selection of a claimant’s option to proceed following receipt of a position letter or resolution proceeding decision
- The issuing of payments on settled claims
Certain steps of the process will not be impacted by this pause and will proceed without interruption. Those include:
- Filing new claims
- Resolution proceedings that are already scheduled
- Scheduling additional resolution proceedings
- Evaluation of resolution proceeding claims, record closure, and issuing final decisions
We understand this news is frustrating for those of you awaiting payment or the AG Designee’s position letter. To the best of our knowledge, the Administrator took this action in response to an uptick in filed claims and in anticipation of proposed changes to the Settlement Fund, which will ultimately benefit victims. While we hope that the Administrator will not implement additional extensions, it remains a possibility, and we will certainly keep you informed of any updates.
What’s NextIn the meantime, our team at Nixon Peabody and Rilee & Associates is doing everything in our power to move your claims forward as quickly and effectively as possible. We will continue to update you on any developments that impact your Settlement Fund claims. |
