Continuing to seek justice for survivors

We are continuing to work around the clock on behalf of our clients. This week, we filed two motions in our class action to reverse the State of New Hampshire’s last-minute changes to the YDC Settlement Fund.

The first motion asks Merrimack County Superior Court Judge Daniel St. Hilaire to tell us whether he has applied for a position on the New Hampshire Supreme Court. If so, this creates a conflict of interest. Governor Kelly Ayotte is named as a defendant in our case, and she is also the person responsible for appointing Supreme Court justices. If Judge St. Hilaire is seeking a Supreme Court position, he should not be hearing our case against the governor. The state has already indicated that it intends to oppose our motion, but we believe our request is a simple matter of transparency.

The second motion asks Judge St. Hilaire to reconsider his decision in denying our request to temporarily prevent the changes to the Settlement Fund from taking effect while our lawsuit is pending. Simply put, we think Judge St. Hilaire misunderstood important points of fact and law, and have asked him to take another look at those points. Of course, if Judge St. Hilaire is disqualified, another judge will end up ruling on this motion.

Both motions have received significant media coverage. That media coverage is good for you—even if you do not have a claim in the Settlement Fund—because it helps us continue to put pressure on the state to do the right thing. You can read more here, here, and here.
